Extortion Bail: Section 384 IPC / 308 BNSS Guide

Arrested under 384 IPC or 308 BNSS for extortion? Learn whether bail is possible, which court to approach, and what to do next.

Extortion Bail in India: Section 384 IPC / Section 308 BNSS

Is extortion bailable or non-bailable?

Extortion under Section 308 BNSS (formerly Section 384 IPC) is a non-bailable offense. Bail is not a right you can claim at the police station — but it is not out of reach. A court can grant bail, and many do.

What does non-bailable actually mean?

Non-bailable means the police cannot release the accused on bail on their own. It does not mean bail is impossible. It means you must apply to a court — and the court decides.

Which court do you approach for bail?

For an extortion case under Section 308 BNSS (formerly Section 384 IPC), you approach the Sessions Court. If bail is refused there, you can apply to the High Court under Section 483 BNSS (formerly Section 439 CrPC), which gives the High Court and Sessions Court wide powers to grant bail in non-bailable cases.

What does the court look at when deciding bail?

The judge weighs factors including:
– The nature and seriousness of the accusation
– The strength of the evidence
– Whether the accused is likely to flee or tamper with evidence
– The accused’s background and ties to the community
– Whether the accused has prior criminal history None of these factors automatically rules out bail. A well-prepared application that addresses each of them gives you the best chance.

One important note on section numbers

India moved from the CrPC to the BNSS in July 2024. If your FIR or charge sheet was filed before that date, it may cite Section 384 IPC. Cases filed after July 2024 will cite Section 308 BNSS. Both refer to the same offense — extortion. The bail process and the courts you approach are the same. Confirm the exact sections on your paperwork with your lawyer.
