The doorbell rings. It’s the police. They don’t have a warrant. Panic sets in, and you comply blindly.

1. Cognizable vs. Non-Cognizable Offences

Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), the law divides crimes into two clear categories:

  • Cognizable Offences (No Warrant Needed): These are serious crimes like murder, rape, kidnapping, or major financial fraud. Under Section 35(1) of the BNSS, police can arrest you immediately without a warrant to prevent flight or destruction of evidence.
  • Non-Cognizable Offences (Warrant Required): These are less severe infractions like simple assault, forgery, or cheating. Under Section 35(2) of the BNSS, police cannot arrest you without a written warrant signed by a Magistrate.

2. The Arnesh Kumar Rule: Arrest is Not Automatic

Even for serious, cognizable offences carrying 7 years or less of prison time, arrest is not a default option.

In the landmark Arnesh Kumar v. State of Bihar (2014) judgment, the Supreme Court ruled that police cannot arrest mechanically. Law enforcement must legally prove the arrest is absolutely necessary to:

  • Stop you from committing further crimes.
  • Prevent tampering with evidence or threatening witnesses.

If an arrest isn’t strictly necessary, police must issue a Notice to Appear (Section 35(3) of the BNSS) instead of putting you in handcuffs.

If police show up without a warrant, stay calm and ask one critical question:

“Is this a cognizable or a non-cognizable offence?”

Force them to declare the charge. If it is non-cognizable, they need a warrant. If it is cognizable but carries under 7 years, they must serve a Notice to Appear first.
